Eight states — Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, Tennessee — headquartered in Atlanta. Seven of eight hold EPA State Program Approval; Florida is the exception, where EPA implements the federal program alongside FDEP. Even inside approved states, EPA's authority never goes away: Region 4 retains §9003(h) inspection and enforcement authority. In emergencies call 911and the NRC 1-800-424-8802.

Florida DEP — Storage Tank Compliance Section, Division of Waste Management
The R4 exception: no approved state program — EPA's federal rules apply alongside Chapter 62-761 · 67 counties with strong delegated local programs (Miami-Dade RER and sisters) · releases reported within 24 hours

South CarolinaSPA-approved 2002 · rev. effective May 24, 2021 · 40 CFR 282.90

TennesseeSPA-approved · 40 CFR 282.92
Tennessee DEC — Division of Underground Storage Tanks
SPA-approved state program; state rules Chapter 0400-18-01 track the revised federal requirements
Florida — the dual-regime, county-powered exception
Florida has no approved state program, so EPA's federal UST rules apply alongside FDEP's Chapter 62-761. On the ground the first phone call is often the county: Florida's 67 counties include some of the country's strongest delegated local tank programs (Miami-Dade RER and its sisters). Releases are reported within 24 hours of discovery.
The funds are named in the federal record
Kentucky's Petroleum Storage Tank Environmental Assurance Fund (KRS 224.60-140) and North Carolina's Leaking Petroleum UST Cleanup Funds (15A NCAC 02P) are incorporated directly into each state's federal approval at 40 CFR 282.67 and 282.83 — financial responsibility is part of the approved program, not an afterthought.
Where state approval stops
South Carolina's 2021 approval revision is explicit: the state's UST approval does not extend to Indian country, including the Catawba Indian Nation. There, EPA itself runs the federal program — the same see-but-never-regulate boundary that applies across every region.
